Amendment #12
if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President.
Class Connection
The Twelfth Amendment (adopted in 1804 following the disputed Election of 1800) provided that elections in which no candidate received a majority should be decided by the House of Representatives from among the top three candidates. Clay used his influence as speaker of the House to swing the election to JQ Adams.
